Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using the ZIRO.FIT platform ("Service"), operated by Ziro sp. z o.o. ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service.

2. Medical & Health Disclaimer

IMPORTANT: The Service is not a medical device and does not provide medical advice.

  • You should consult your physician or other health care professional before starting this or any other fitness program to determine if it is right for your needs.
  • Do not rely on the Service for the prevention, diagnosis, or treatment of any physiological or psychological condition.
  • You knowingly and voluntarily assume all risks and dangers associated with physical exercise, including the risk of injury or death.

3. AI Features Disclaimer

The Service utilizes Artificial Intelligence (AI) to generate workout recommendations, analyze data, and provide coaching tips.

  • Accuracy: AI-generated content may be inaccurate, incomplete, or inappropriate. You are responsible for evaluating the accuracy of any output before relying on it.
  • No Professional Advice: AI features are for informational purposes only and do not replace the judgment of a certified human trainer or medical professional.

4. User Accounts

To use the Service, you must register an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account.

5. Trainer Services & Payments

5.1 For Trainers

If you use the Service as a Trainer:

  • You represent that you hold valid certifications and insurance required by your local jurisdiction to provide fitness instruction.
  • You agree to pay applicable subscription fees to access premium features. Subscription fees are billed in advance on a recurring basis and are non-refundable.
  • If you sell services through ZIRO.FIT, you agree to our platform fees (application fees) deducted automatically from transactions processed via Stripe.

5.2 For Clients

If you purchase packages or services from a Trainer via ZIRO.FIT:

  • You understand that you are transacting directly with the Trainer, not ZIRO.FIT. We act solely as a technology facilitator.
  • Refund requests for Trainer services must be directed to the Trainer.

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of the data, photos, and workout logs you upload ("User Content"). By uploading User Content, you grant ZIRO.FIT a non-exclusive, worldwide, royalty-free license to use, store, and display such content solely for the purpose of providing and improving the Service.

6.2 Prohibited Content

You may not upload content that is illegal, offensive, sexually explicit (including nudity in progress photos), or infringes on the rights of others. We reserve the right to remove any content that violates these Terms.

7. Subscription Cancellation

You may cancel your ZIRO.FIT subscription at any time via the "Billing" section in your dashboard. Cancellation will take effect at the end of the current billing period. We do not provide refunds for partial subscription periods.

8. Limitation of Liability

To the fullest extent permitted by law, Ziro sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service;
  • Any conduct or content of any third party on the Service;
  • Any content obtained from the Service; and
  • Unauthorized access, use, or alteration of your transmissions or content.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.
